By using BBS Radio TV services, you acknowledge reading, understanding, and agreeing to these Terms. Non-agreement prohibits Services use.
1. Agreement to Terms
BBS Network, Inc., a Texas corporation, provides these legally binding Terms governing access to bbsradio.com and related Services. Users acknowledge agreement by accessing the platform or clicking acceptance buttons. BBS reserves modification rights with notice via updated posting and date changes. Continued use constitutes acceptance.
2. Eligibility
Services require users be at least 18 years old. Users represent they possess legal capacity, face no legal prohibitions, and will comply with applicable laws. BBS does not knowingly collect information from children under 13 and will promptly delete such data if discovered.
3. Account Registration and Security
Users must provide accurate information when creating accounts. Users bear responsibility for credential confidentiality and all account activities. BBS may suspend or terminate accounts at its discretion without notice for violations or other reasons.
4. Description of Services
BBS Radio TV operates a broadcasting and podcasting platform enabling content creation, uploading, and distribution. Services include talk show hosting, podcast creation, music submission, guest applications, and AI-powered music generation called "Make Music."
5. User Content and License Grant
Users retain ownership of submitted content but grant BBS a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license for using, reproducing, and distributing material across all media. This license includes syndication rights to over 190 broadcast stations and platforms. The license survives account termination. BBS has no obligation removing syndicated content after deletion. Users receive no additional compensation beyond service access.
6. Content-Specific Terms and Warranties
Music Submissions: Users warrant they own or control all rights in musical compositions and sound recordings, possess authority to grant licenses, and submissions don't infringe third-party rights. Written Works: Users represent sole authorship or obtained rights, possess derivative work authorization, and content is original without infringement. Biographical Information: Users warrant accuracy, photograph rights, non-violation of others' legal rights, and consent to name and likeness usage. Users grant BBS a worldwide, royalty-free, perpetual publicity rights license for names, likenesses, images, voices, and biographical information without additional compensation.
7. AI-Generated Content Services — Make Music
BBS offers AI music generation for $99 per submission, creating up to five tracks from submitted text. Users acknowledge AI outputs don't guarantee quality, satisfaction, or copyright protection. AI may inadvertently resemble existing works; users assume all associated risks. Make Music uses third-party AI technology subject to provider terms. Users bear sole responsibility for ensuring AI-generated content doesn't infringe third-party rights before commercial exploitation. Refunds apply only for technical generation failures within fourteen days. Dissatisfaction with creative output receives no refunds.
8. Prohibited Conduct
Users cannot upload infringing content, unlawful or abusive material, impersonate others, interfere with Services, attempt unauthorized access, use automated tools without permission, circumvent security features, violate laws, or encourage others' violations.
9. Intellectual Property Rights
BBS owns exclusive Services intellectual property excluding User Content, protected under U.S. and international law. Users receive limited, non-exclusive, non-transferable licenses for personal or internal business use. "BBS Radio TV," related names, logos, and marks require written permission for use.
10. Copyright Infringement and DMCA Policy
BBS terminates repeat infringers per DMCA compliance. Users may submit counter-notifications for mistaken content removals under DMCA procedures.
11. Third-Party Services and Links
BBS doesn't control third-party websites or services linked through the platform and assumes no responsibility for their content, policies, or practices.
12. Fees and Payment
Service features may require payments in U.S. dollars. All fees are non-refundable except expressly stated or legally required. Third-party payment processors handle transactions under their terms and privacy policies. Users bear applicable tax responsibility except BBS net income taxes.
13. Termination
Users may terminate accounts anytime by contacting BBS. Termination doesn't relieve prior obligations or affect granted rights. BBS may suspend or terminate access without notice for policy violations or other reasons. Upon termination, user access ceases immediately. BBS may delete non-syndicated account information. Granted licenses survive and remain effective.
14. Disclaimer of Warranties
Services are provided "as-is" and "as-available" without warranties. BBS disclaims all express and implied warranties including merchantability, fitness, title, and non-infringement. BBS doesn't warrant uninterrupted, timely, secure, or error-free service or content free from defects or infringement. User risk assumption is complete.
15. Limitation of Liability
BBS, officers, directors, employees, agents, affiliates, licensees, syndication partners, and service providers bear no liability for indirect, incidental, special, consequential, punitive, or exemplary damages, lost profits, lost data, service interruption, or substitute service costs. BBS's total cumulative liability equals the greater of amounts paid in preceding twelve months or $100.
16. Indemnification
Users indemnify, defend, and hold harmless BBS, its officers, directors, employees, agents, affiliates, licensees, syndication partners, successors, and assigns from claims, damages, losses, costs, investigations, liabilities, judgments, fines, penalties, settlements, and expenses from User Content, Terms breaches, third-party right violations, AI-generated content use, law violations, or Services use.
17. Dispute Resolution
Users and BBS resolve disputes through final binding individual arbitration administered by the American Arbitration Association under Consumer Arbitration Rules in Tarrant County, Texas, except small claims court exceptions apply. BBS pays AAA fees for claims under $10,000 unless arbitrators find claims frivolous. Class Action Waiver: Each party brings claims only individually, not as class or collective action plaintiffs.
18. Governing Law and Jurisdiction
Texas state law governs these Terms and disputes, excluding conflict principles. Subject to arbitration provisions, exclusive state and federal court jurisdiction lies in Tarrant County, Texas.
